The purpose of this work is to analyze the crimes provided for by the criminal law of such Spanish-speaking countries of the Latin American region as Peru and Ecuador related to illegal mining of minerals, including coal. The article, in particular, reveals the features of such crimes, identifies similarities inherent in different offenses, defines the gaps in criminal law regulation as well as makes proposals for revising the existing gaps in the criminal legislation of Latin American countries. For this, methods such as normative and doctrinal analysis are used. The authors come to the following conclusions: the criminal legislation of these states provides for similar legal norms, and criminal legal means are the main ones for regulating the studied illegal actions, however such legal regulation continues to contain certain imperfections.
