DEVELOPMENT OF PROPOSALS FOR UPDATING THE CRITERIA FOR CLASSIFYING CIVIL SERVICE CONDITIONS AS HARD, HARMFUL AND DANGEROUS IN THE COAL INDUSTRY
Abstract
The coal industry of the Russian Federation holds a leading position in terms of the share of workers employed in harmful and hazardous working conditions – 79.1% according to 2021 data. The existing criteria for classifying civil service conditions as hard, harmful and dangerous, established in Federal Law No. 79-FZ and related regulations, do not take into account the industry-specific features of coal mining: the combined effects of dust, gas, noise and vibration factors, as well as the high probability of emergency situations. The purpose of the study is to develop scientifically substantiated proposals for updating the criteria for classifying civil service conditions as harmful and dangerous with regard to the specifics of the coal industry. The methodological basis includes regulatory and legal analysis, statistical processing of Rosstat and Rostechnadzor data for 2019-2024 (n = 148 coal mining enterprises in Kuzbass), expert survey (84 respondents), and the method of integral indexing of occupational risks. The results showed that the current classification underestimates the actual level of harmfulness for 34.7% of the surveyed workplaces by 1-2 subclasses. The integral index of occupational risk for underground mining was 0.78 (with the “dangerous” threshold of 0.70), while for civil servants of supervisory authorities operating directly at coal mining facilities it was 0.52, corresponding to class 3.2-3.3. A modified criteria matrix with the introduction of an industry adjustment coefficient Kind = 1.15-1.35 and an expanded list of production factors is proposed. The practical significance of the work lies in the formulation of recommendations for improving the system of state guarantees for civil servants carrying out supervisory activities at coal enterprises.
