Abstract
The interests of various entities may and often do not coincide, it is impossible to put an equal sign between the needs, values and requirements of the employee and the employer. Moreover, a clash of interests may also exist for an individual citizen, for example, a conflict of interests between a parent and an employee, the need for professional growth and raising children. The latter, as is known, is not only the right, but also the responsibility of a parent. In this regard, the current legislation should contribute to achieving a balance of interests, which, ultimately, meets the interests of the state itself. In this article, based on the analysis of the norms of labor and family legislation of the Russian Federation, a conclusion is made about cases when a father and other persons can use the benefits and guarantees established by the current legislation for mothers; the nature and essence of these guarantees are noted, the problems arising when applying the rules on guarantees to fathers are listed, and ways to resolve them are proposed.
